Although many senators had concerns about his conservatism, particularly in regard to the landmark Roe v. Wade ruling, there was little reason for a derailment of his confirmation. Furthermore, Alito showed thoughtfulness, civility and intelligence during the hearings. Being a conservative nominated by a conservative just isn’t grounds for a filibuster. Still, Alito’s ascension to the tribunal followed one of the most narrow votes in modern history – 58-42 , with all but four Democrats voting against him. The voting signifies a deep and fundamental concern in the country about the serious conservative shift of the court. Alito replaced retiring Justice Sandra Day O’Connor who widely was seen as the court’s swing vote, the moderate who added balance to the conservative and liberal elements.
